Terms of Service

These Terms of Service ("Terms") govern your access to and use of Flicker, a hosted Postgres branching service operated at flickercloud.com ("Flicker", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. Service description

Flicker provides hosted PostgreSQL databases with copy-on-write branching. The service is currently offered as a closed beta. Features, limits, and pricing may change as the product evolves.

2. Accounts and invitations

Access during the closed beta requires an organization-scoped invitation. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You must be at least 18 years old to use the service.

3. Acceptable use

Your use of Flicker must comply with our Acceptable Use Policy. Violations may result in suspension or termination without notice.

4. Fees and billing

Plans are billed in advance through Stripe on a flat monthly tier. Fees are non-refundable except where required by law. You may cancel at any time via the customer portal; cancellation takes effect at the end of the current billing period.

5. Your data

You retain all rights to data you store in Flicker. You grant us a limited license to host, process, and back up that data solely to operate the service. See our Privacy Policy and Data Processing Addendum for details.

6. Service availability

During the closed beta we target best-effort availability as described in our SLA. The service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted operation, and scheduled maintenance windows may affect availability.

7. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.

8. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a risk to the service or other customers. On termination we will retain backups per our retention policy and then delete your data.

9. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced by email to the address on file. Continued use after the effective date constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of laws principles.
